Consumer rights & refunds (Australia)

Under the ACL, consumers are entitled to guarantees including that services will be rendered with due care and skill, fit for a specified purpose and delivered within a reasonable time. These statutory guarantees cannot be excluded.

Refunds, replacements or remedies will be provided where there is a major failure or where a failure cannot be remedied within a reasonable time. For non-major failures, Brightoffers may offer remedies such as re-performance or partial refunds as appropriate.

How to request a remedy

Email Brightoffers@outlook.com with order details, nature of the issue, and preferred outcome. We will acknowledge within 2 business days.

Limitation of liability

Except for non-excludable rights under the ACL, Brightoffers' liability for loss or damage arising from our services is limited to the amount paid for the relevant services or to resupply of the services.

We are not liable for indirect, special or consequential loss, lost profits, or loss of data to the extent permitted by law.

Intellectual property

All creative materials, strategies and proprietary tools created by Brightoffers remain our intellectual property unless otherwise agreed in writing. Clients receive a licence to use deliverables for their business purposes once fees are paid.

Privacy & data handling

We collect and process personal information necessary to provide services. Our Privacy Policy (see link below) explains purposes, legal bases, retention and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Complaints & dispute resolution

If you have a complaint, please contact support at Brightoffers@outlook.com with details. We aim to resolve complaints promptly. If internal resolution is unsuccessful you may contact:

  • Australian Competition & Consumer Commission (ACCC)
  • State consumer protection agencies
  • Small Business Commissioner (Victoria) for mediation assistance

This does not limit your rights under the ACL or other mandatory protections.

Terms summary & common questions

Deliverables and milestones are set out in client proposals. Changes to scope may incur additional fees. Timelines are estimates and subject to client approvals and platform review times.

Prepaid retainers are non-refundable once work has commenced. For digital products not as described, remedies under ACL apply. Cancellation terms are defined in client agreements.

We endeavour to ensure all advertising complies with Australian advertising standards. Clients must not request misleading claims; client-provided claims must be substantiated.
